Conditions of Liability for RAPID’s Independent Resellers

1. Introduction
This page outlines the relationship between RAPID (hereinafter referred to as “the Manufacturer”) and resellers, installers, or commercial partners who distribute and install RAPID products.

2. Legal Status of Resellers
Each reseller or partner is an independent legal entity, with its own VAT number and full civil and criminal liability.
Every reseller operates under independent management and ownership, separate from the Manufacturer.
They do not act as affiliates, agents, or representatives of RAPID, but rather as independent professionals.

3. Informational Role of the Manufacturer
RAPID may provide end users with the names of geographically nearby resellers and, upon request, general product-related information.
Such information is purely indicative and does not involve any direct technical assessment by the Manufacturer.
RAPID does not conduct on-site inspections, surveys, or evaluations of installation conditions.

4. Responsibility of the Client and the Designer
It is the sole responsibility of the end client to appoint a qualified designer in the country where the product is to be installed, to:
– assess the specific characteristics of the site;
– collaborate with the reseller to determine the most suitable solution;
– issue a written and signed report with precise instructions for correct installation.
If the device is installed without such a dedicated technical report or in violation of the provided instructions, the client must not use the device in the event of even a minor flood alert, in order to prevent further damage or serious consequences.

5. Commercial Relations and Transactions
Any activity, including but not limited to:
– site assessment,
– quote preparation,
– contract agreement,
– deposit or balance payments,
– delivery,
– installation,
– after-sales service,
is to be considered under the sole responsibility and liability of the reseller, and not of the Manufacturer.

6. Limitation of RAPID’s Liability
RAPID does not issue any warranties or representations regarding the actions, omissions, or performance of independent resellers or installers.
The Manufacturer disclaims any liability for non-performance, failed deliveries, incorrect installations, or any other issues caused by third parties not directly supervised.

7. Contacts and Claims
For any disputes, requests, or concerns related to quotes, payments, deliveries, or installations, the customer must contact the reseller directly, who has been entrusted with the service or commercial transaction.
